Terms & Conditions

Last updated: 2026

This is a plain-language template and not legal advice. Have it reviewed by an Australian lawyer before you rely on it commercially.

Independence

SkillCount is an independent study and practice tool. It is not affiliated with, endorsed by, or connected to ACARA or any government body, and it does not administer the official NAPLAN test or provide official results or accommodations. "NAPLAN" is used only to describe the assessment our practice material is designed for.

1. Acceptance

By creating an account or using SkillCount ("the Service"), you agree to these Terms & Conditions and our Privacy Policy. If you are signing up on behalf of a child, you confirm you are their parent or legal guardian and consent to their use of the Service.

2. The Service

SkillCount provides practice questions, mock exams, adaptive testing and progress insights to help Australian students prepare for NAPLAN. Content is for educational practice only and is not affiliated with or endorsed by ACARA or any government body.

3. Accounts

You are responsible for keeping your login details secure and for all activity under your account. You must provide accurate information and keep it up to date.

4. Subscriptions & Billing

We offer a free plan and paid subscription plans. Paid plans renew automatically until cancelled. Prices are in Australian dollars and include GST where applicable. You may cancel at any time; access continues until the end of the current billing period. See our Refund Policy below.

4a. Refund Policy (pro-rata)

If you cancel or request a refund on a paid plan, you may request a pro-rata refund for the unused portion of your current billing period — for example, cancelling a monthly plan halfway through the month refunds roughly half the fee. You can request a refund from your Subscription page; we calculate the indicative pro-rata amount and process the refund through our payment provider (Paddle, which acts as merchant of record), returned to your original payment method. Nothing in this policy limits your rights under the Australian Consumer Law, including remedies where a service is not of acceptable quality.

5. Children's Data & Privacy

We collect only the personal information needed to provide the Service (such as a child's name, year level and practice results). A parent or guardian may request access to, correction of, or deletion of a child's data at any time from account settings, and we will action deletion requests promptly. We handle personal information in line with the Australian Privacy Act and applicable children's privacy requirements.

6. Acceptable Use

You agree not to misuse the Service, share account access beyond your household or permitted students, attempt to disrupt the platform, or copy and redistribute our content.

7. Cancellation & Termination

You may close your account at any time. We may suspend or terminate accounts that breach these terms. On deletion, your data is handled per our Privacy Policy and retention practices.

8. Disclaimers & Liability

The Service is provided "as is". We do not guarantee particular NAPLAN results. Nothing in these terms excludes rights you have under the Australian Consumer Law. To the extent permitted by law, our liability is limited to resupplying the Service or refunding the fees paid for it.

9. Governing Law

These terms are governed by the laws of Australia. Any dispute will be handled in the courts of the state or territory in which you reside, and nothing in these terms limits your rights under the Australian Consumer Law.
